Effective 28 September 2026 · Version 2026-09-28.3
Terms of Service
The general terms for OWNB accounts and trademark search and filing engagements.
1. Purpose and contracting parties
These terms govern the use of OWNB, operated by Sunrich International Patent & Law Firm (Principal Patent Attorney Yoon Bae Kim; Business Registration No. 220-08-91983; Online Business Registration No. 2026-Seoul Jung-gu-1139; the Firm), and the rights and obligations of the Firm and its users. The Firm is the contracting party and service provider for trademark searches, filings, and related legal services.
HEDGEROW WORKS is a technical contractor responsible for OWNB system development, maintenance, and incident response. It is not a contracting party, representative, or legal decision-maker for the legal services.
2. Services
•
OWNB provides account registration, application forms, document submission, fee information, progress updates, notifications, and consultation features.
•
Depending on the service selected, the Firm reviews distinctiveness and earlier marks, defines designated goods, prepares and files applications, and provides progress updates.
•
Post-filing office action responses, registration fee payments, renewals, proceedings and litigation, overseas filings, and other related work are separate services with separate fees unless expressly included at checkout or in a separate notice.
•
Consultation staff may assist with intake, scheduling, and document guidance. Legal judgments, final reports, and representative work are reviewed and finalized by the responsible patent attorney.
3. Formation of the engagement and commencement of work
An engagement for paid work is formed when the user reviews the application details, total price, included and excluded services, and cancellation and refund terms, expresses an intention to instruct the Firm, and the Firm confirms receipt of the transfer or payment. The order number and the versions of the documents accepted on screen are retained as evidence of the engagement.
If the user requests immediate commencement, the Firm may begin the earlier-mark search and report preparation once payment is confirmed. Work already completed may be excluded from withdrawal or refund to the extent permitted by applicable law.
4. Information and checks required from users
•
Users must act on their own behalf or as an authorized representative of a legal entity and provide accurate applicant, trademark, business, and contact information.
•
Users must have the necessary authority to use and provide any third-party marks, images, documents, or contact information they submit.
•
Changes to addresses, contact details, or rights, and official notices or circumstances affecting deadlines, must be reported without delay.
•
Users are responsible for reviewing reports and draft applications and considering the consequences of their chosen course of action.
5. Fees and additional work
The payment screen distinguishes service fees, VAT, and Korean IP Office fees, or displays the total together with its calculation basis. The initial amount is based on the selected marks, number of classes, and standard or priority examination route. If the final scope or examination route changes after the report review and before filing, the amount is recalculated. An increase is payable after the user's confirmation. A decrease is refunded after deducting any work already performed.
Office action responses and registration fees and procedures following approval are not included in the initial filing fee. When needed, the scope of work, service fees, and official fees are explained separately, and work proceeds after the user's confirmation.
Each mark paid for together in a multiple-trademark application is an independent application and right. Fees, refunds, and decisions on whether to file may be handled according to the allocation for each case or class.
6. Searches, reports, and generative AI assistance
Generative AI may be used to assist trademark searches and the preparation of report wording. The responsible patent attorney reviews and finalizes the legal conclusions and the reports provided to clients.
A report is a professional opinion based on the information provided and the material available at the time of the search. It does not guarantee registration, examination times, or dispute outcomes. Results may differ depending on the Korean IP Office's examination, third-party claims, and actual use.
7. Electronic communications and records
The Firm may communicate engagement details, progress, and deadlines through the account screen, notifications, consultations, the sign-in email address, or a separate contact email specified by the user. Duplicate addresses may receive only one message. Users should check spam folders and keep their contact details current.
Downloadable reports, receipts, documents, and delivery records may be provided electronically.
8. Service restrictions and termination
For false or unlawful applications, infringement of third-party rights, system abuse, unpaid fees, or prolonged failure to provide information needed for the work, the Firm may request a remedy within a reasonable period and suspend or terminate some or all services. Urgent infringement or security risks may require action before notice.
Provisions concerning costs already incurred, statutory retention obligations, ongoing official procedures, and deadlines remain effective after termination to the extent necessary.
9. Liability and dispute resolution
The Firm is liable under applicable law for damage caused by its intent or negligence. Liability may be limited, to the extent the Firm is not responsible, for consequences arising from inaccurate information, unauthorized materials, delayed replies, or external institutions or communications networks. These terms do not exclude statutory rights to the detriment of consumers.
Enquiries and complaints may be submitted to 02-563-4598 or ownb@sunrichpat.com. Disputes that cannot be resolved by agreement are governed by the laws of the Republic of Korea. Jurisdiction is determined by the Civil Procedure Act and other applicable laws.
10. Changes to these terms
The Firm may amend these terms following changes in law or services. Important changes and their effective dates will be announced in advance through the service. Material changes unfavorable to users will be notified with reasonable advance notice. Individual engagements formed before an amendment remain subject primarily to the terms accepted at that time.
For questions about these documents or their scope, contact us through OWNB chat or the firm's contact details.
